THE CLIENT HEREBY AGREES TO THE FOLLOWING TERMS FOR EACH SERVICE RENDERED, WHICH TERMS SHALL BE READ AND INCORPORATED INTO THE AGREEMENT REFERED TO IN THE TERMS OF SERVICE:

1. VEHICLE CONTENT AND VEHICLE SERVICES RELEASE OF LIABILITY 
   1. Client understands and agrees that the Archive Automotive (Pty) Limited (“the Company“) that the performance of the Vehicles Services carry a certain amount of risk, including but not limited to the following:
      1. the Company cannot guarantee that the Vehicle Services will remove of all contaminants or defects, including, but not limited to upholstery stains, oil stains, chipped or loose paint, etc;
      2. Vehicle Services rendered such as pressure washing, chemical spot cleaning, polishing, ceramic coating and wrapping, may reveal imperfections in surfaces that were not visible prior thereto and which cannot be corrected using the Vehicle Services; and
      3. the presence/combination of water and high pressure associated with pressure washing present certain risks which can lead to permanent damage(s) to the structure being cleaned as well as other Vehicle Contents in, under, on, or around the general area of the structure being cleaned.
   2. The Client understands and assumes these risks and waives and releases the Company from, from any liability for any loss or damage to Vehicle(s) and or Vehicle Content, visible or otherwise, that occurred before, during, or after Vehicle Services are performed and against, any and all claims brought against the Company as a result of their performance of the Vehicle Services.
2. VEHICLE CONTENT AND STORAGE SERVICES RELEASE OF LIABILITY 
   1. To the best of their abilities, the Company and it’s employees will secure the Vehicle(s) and the Vehicle Content, but the Client releases all liability towards the Company for any property, including the Vehicle itself, that is damaged or stolen during the time the Vehicle is in possession of the Company.
   2. Vehicle Content left in the Client’s Vehicle or on Site during the period the Vehicle is being stored at the Site is the responsibility of the Client.
3. INDEMNIFICATION: 

CLIENT AGREES TO AND SHALL FULLY INDEMNIFY, HOLD HARMLESS, AND DEFEND THE COMPANY, ITS OWNERS, AGENTS, AND EMPLOYEES, FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, ACTIONS, SUITS, DAMAGES, LIABILITIES, LOSSES, SETTLEMENTS, JUDGMENTS, COSTS AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEY’S FEES AND COSTS) ETC, ARISING OUT OF OR IN CONNECTION TO SERVICES PERFORMED UNDER THE AGREEMENT, WHETHER OR NOT CAUSED IN PART OR IN WHOLE BY THE NEGLIGENCE OF THE COMPANY ITS OWNERS, AGENTS OR EMPLOYEES, OR FORCE MAJURE.  

4. PUBLICITY

The Client agrees to allow the Company to use whichever medium necessary to publicise the Services provided to its clients, including the Client, and publish on any marketing platform deemed acceptable and non-threatening to the wellbeing of the Client. Any confidentiality of the Service being provided needs to be relayed to the Company prior to the beginning of Services.

5. AUTHORITY

The Client warrants and agrees that they are the legal and/or registered owner of the Vehicle(s), or has full permission from the owner to have Services performed on the Vehicle(s) and to sign this liability waiver.
